Die Forschungsstelle für anglo-amerikanisches Recht AREA (Augsburg Research Centre of European and Anglo-American Law) unter der Leitung von Professor Dr. Thomas M.J. Möllers ist ein Zentrum für die Zusammenarbeit von Wissenschaftlern aus Deutschland und dem anglo-amerikanischen Raum im juristischen Kontext.
So ist im Bereich der Rechtsdurchsetzung vor allem das US-amerikanische Recht dem deutschen oder nationalen Recht voraus. Stichwörter wie "punitive damages" und "deep pocket doctrine" sind im US-amerikanischen Rechtssystem Alltag und gewährleisten, dass das gesetzte Recht beachtet wird.
Forschung
Der aktuelle VW-Skandal zeigt deutlich, wie verwoben unsere Märkte sind. Die Globalisierung stellt die Herausforderung an die juristische Wissenschaft, dass trotz teilweise erheblicher Unterschiede in den verschiedenen Rechtssystemen darauf zu achten ist, dass Kunden ein und desselben Unternehmens nicht dadurch benachteiligt werden, dass sie einer anderen Rechtsordnung unterliegen, die weniger effektive Rechtsdurchsetzungsmechanismen zur Verfügung stellt.
Gastprofessoren
Die Forschungsstelle ist stolz auf ihre Zusammenarbeit mit zahlreichen Gastprofessoren aus dem anglo-amerikanischen Raum. Hier finden sie eine Auflistung der verschiedenen Professoren und Universitäten, mit denen seit Jahren ein reger Kontakt gepflegt wird.

In their sociological contribution to law in honour of Prof. Rosalba Alessi, Prof. Dr. Thomas M.J. Möllers and Jan Längle explore the significance of legal culture for supreme court jurisprudence. In light of the partnership between the Universities of Augsburg and Palermo, the paper focuses on a comparative analysis of law in Germany and Italy. The starting point for their considerations is the remarkable parallel between the constitutional reservations regarding the primacy of European law found in both countries. This is contrasted with remarkable similarities in the historical development of the federal structure of both countries. The article highlights the extent to which this legal cultural background also shapes the understanding of European integration.

The article "Conflicting Regulatory Objectives in Data Protection Law - A Comparative Law Analysis Considering the Legal Culture in the EU, The US, and the PR ChinaData" published in "Osservatorio del Diritto Civile e Commerciale" compares the most important principles of data proteciton law in Europe, the USA and the PRC: Data is the oil of the 21st century. Yet despite its global relevance, data protection is regulated very differently in the EU, the US, and the People's Republic of China, the world's major eco-nomic centers. This analysis describes the respective legal and cultural backgrounds of the various economic power houses in order to explain the different approaches towards data protection. Comparative law seeks to assess the feasibility of legal transplants. The role of legal culture in this regard has previously been understated. The following deliberations attempt to use the example of data protection to illustrate how culture shapes perceptions of justice and how similarity of these perceptions is a precondition for legal transplants.

The Augsburg Summer Program on European and International Economic Law takes place from June 8 to July 17, 2026.
Nowadays, large companies operate on a global scale and must comply with the respective national legal systems. Therefore, basic knowledge is essential in the field of European data protection law, antitrust law, intellectual property law, as well as corporate and capital markets law.
The University of Augsburg offers the Augsburg Summer Program to international foreign students to join German practicing lawyers and German postgraduate law students for a unique studying experience for a six-week intensive course.
The intention of this Program is to impart knowledge in the basic framework of transnational Economic Law through lectures and examination courses in order to meet the increasing requirements of companies and law firms in this field. All of the lectures and talks will be offered in English. After the successful completion of the program, you will receive a formal certificate.
